1. Acceptance of Terms

By visiting, registering on, or using Evanto, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, along with our Privacy Policy, Compliance Page, and any other legal documents referenced on the site.

If you are using the platform on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.

2. Independent Brand & No Harm Policy

2.1 Autonomous Brand Creation

Evanto has been developed independently by Banglar Katha as a separate and self-contained business initiative. Any resemblance in naming or concept to other platforms is unintentional and coincidental.

2.2 No Malicious Intent

Evanto and Banglar Katha clearly and expressly state that we do not:

• Intentionally target, attack, disrupt, or damage the business operations of any other platform.
• Engage in defamatory, deceptive, or misleading practices directed at other businesses.
• Promote or practice malicious competition, sabotage, or any harmful conduct.
• Encourage users or vendors to engage in unlawful or harmful behavior towards others.

2.3 Market Co-Existence

Evanto recognizes the right of other platforms to operate in the same or similar business fields. We aim to conduct our business fairly and lawfully, focusing on our own services and customers without interfering with the legitimate operations of others.

3. Eligibility & User Accounts

3.1 Eligibility

To use Evanto, you must:

• Be at least 18 years of age or the age of majority in your jurisdiction.
• Have the legal capacity to enter into a binding contract.
• Use the platform in compliance with applicable laws.

3.2 Account Registration

4. Business Terms & Platform Use

4.2 License to Use Platform

Subject to these Terms, you are granted a limited, non-exclusive, non-transferable, revocable license to access and use the platform solely for lawful purposes.

4.3 Prohibited Uses

You agree not to:

• Use the platform for any illegal or unauthorized purpose.
• Violate any applicable law, regulation, or third-party rights.
• Upload or distribute malware, harmful code, or disruptive scripts.
• Attempt to interfere with the security, integrity, or availability of the platform.

5. Purchasing Terms & Transaction Rules

5.1 General Purchasing Process

When you purchase a product or service on Evanto, you agree to the specific terms displayed at the time of purchase, including price, license type (if applicable), usage rights, and any vendor-specific conditions.

5.2 Contractual Nature of Purchase

Each purchase constitutes a transaction between you and the platform and, where applicable, between you and the vendor listing the product. The platform provides necessary infrastructure, order management, and delivery mechanisms within commercially reasonable efforts.

5.3 Non-Binding Beyond Legitimate Business Scope

Certain portions of these Terms and related policies describe ideal or recommended practices for business operations. Such descriptive or explanatory clauses are not intended to create obligations beyond:

• Legal requirements imposed by applicable law.
• Core contractual obligations necessary to fulfill your order.
• Basic platform rules required to maintain order and safety.

Where language could be read as going beyond lawful and practical business obligations, it shall be interpreted in a reasonable, non-onerous manner consistent with the purpose of proper order maintenance and business legitimacy.

5.4 Anonymous Purchases & Non-Binding Extensions

Where purchases are made using minimal or anonymized information (subject to legal constraints), Evanto will:

• Provide access to purchased digital goods or services as per the order.
• Maintain transaction records for compliance and support purposes.

However, such purchases do not create additional long-term obligations, guarantees, or liabilities on Evanto beyond delivering what was purchased and complying with applicable laws and clearly stated policies.

6. Vendor / Seller Terms

6.1 Vendor Registration

Vendors may be required to undergo verification, KYC, or additional checks depending on the nature of their offerings and applicable regulations.

6.2 Listings & Content Responsibility

Vendors are solely responsible for the content, accuracy, and legality of their listings, including descriptions, pricing, and compliance with intellectual property and other laws.

6.3 Commission, Fees & Payouts

Evanto may charge commissions, listing fees, or service charges as specified in vendor documentation or dashboards. Payouts are subject to clearance, anti-fraud checks, and compliance requirements.

7. Intellectual Property & Fair Market Conduct

7.1 Evanto IP

All platform code, design, branding, logos, and original content associated with Evanto are owned or lawfully licensed by Banglar Katha.

7.2 Respecting Others' Rights

Evanto and its users must respect intellectual property rights of third parties. We prohibit uploading or distributing content that infringes the rights of others.

7.3 No Direct Targeting of Other Platforms

Evanto does not support or allow the use of the platform to directly attack, defame, or disrupt other platforms or businesses. Users must not use Evanto to coordinate harmful actions against any third party.

8. Disclaimers & Limitation of Liability

8.1 Service "As Is"

Evanto is provided on an "as is" and "as available" basis. While reasonable care is taken, no absolute guarantees are made regarding uninterrupted service, error-free operation, or complete security.

8.2 Third-Party Vendors & Content

Products and content provided by vendors are their responsibility. Evanto is not liable for inaccuracies, defects, or issues arising directly from vendor-provided content or products, except where explicitly required by law.

8.3 Limitation of Liability

To the maximum extent permitted by law, Evanto and Banglar Katha shall not be liable for indirect, incidental, consequential, or punitive damages arising out of your use of the platform.

9. Suspension & Termination

Evanto may suspend or terminate access to the platform or specific accounts if:

• These Terms are violated.
• Fraudulent, illegal, or harmful activity is suspected.
• Compliance or security reasons require such action.

Users may discontinue using the platform at any time, subject to settlement of any outstanding obligations.

10. Changes to These Terms

Evanto reserves the right to modify or update these Terms from time to time. Significant changes may be notified via the website or email (where appropriate). Continued use of the platform after changes become effective constitutes acceptance of the updated Terms.

11. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in the relevant jurisdiction where Banglar Katha operates.
